    • You should read Patterico’s update. BK just timed a warrant with a stack of jibberish directly to a judge on the Sunday before the hearing. those warrants are directly between the accuser and a judge (no prosecutorial vetting in Maryland, apparently).

      Aaron shows up for the case, and FINDS OUT there’s been a warrant filed for his arrest. The case Aaron presented had nothing to do with the charge and neither did the assault charge (the deputy made an error-he couldn’t keep track of which of BK’s many lawsuits he was following up on).

      Judge believes BK’s bullshit stack of papers and google notifications as legitimate “contact” and sides with the “better safe than sorry” aspect of the case. Aside from being blatantly unconstitutional; the judge also knows jack shit about the internet.

      Did BK win? A round. I’m fairly sure it’ll be overturned and he’ll be back to blogging about BK in no time. Once he does win it will make it that much harder for BK to file suit (remember he files suit in his home state and makes you come to answer to it).

        3 things:

        1) SLAPP
        2) California
        3) Public Person

        On SLAPP in California you file one motion and the other side has to show their cards before any discovery happens. It makes for a high hurdle and pretty much eliminates this form of Lawfare. You can also counter sue and get your court costs / attorneys fees.

        And if you are a homeowner in California and have an umbrella policy, you just call your insurance company and they take care of the bills (and then recover their costs from the other side).

My gut tells me that Kimberlin’s pushed for it for a while and then claimed it was an emergency. He’s got to file in person, I knwo, but that’s what Patterico said.

    in Maryland, you can file suit, speak to a judge without your accussee around; and if you can convince them of your bullshit they’ll issue the warrant. Patterico goes on to say that the warrants are vetted on merit sometimes WEEKS after they’re issued by the judge.

    No wonder BK sues everyone from Maryland, sound like a great place to be a legal pest.

      What happened was:
      Wealthy Edwards fan girl and donor gives Edwards hush money to give to his mistress.

      The prosecution was trying to claim that it was a political contribution, and thus in violation of campaign finance laws. I’m not really sold on the argument, from what I know of the case.

      One of the smoking guns was that the fan girl wrote ‘To Save America’ on one of the checks in the memo field, as opposed to ‘For Shutting up Your Skank-Whore Baby Momma’

        Being a criminal case, the standard is beyond a reasonable doubt (and to a moral certainty), and there was some wiggle room on whether or not Edwards solicited these funds from private donors as “gifts” rather than campaign funds.

        Of course, I have to ask. Did anyone determine if Edwards paid TAXES on these gifts? Because he would have been obligated to if they were not, in fact, donations. My guess is no. If so, time to call the black suits in the IRS.
